The basic components of a divorce in Georgia include:
Grounds for divorce– Georgia is a No-Fault divorce state, but there are also 12 situations for an At-Fault divorce including desertion and adultery.
Residency– One spouse must have lived in Georgia for at least six months.
Equitable Distribution- In Georgia, property must be divided fairly – but that does not always mean a 50/50 split.
Alimony- Not every divorce will include alimony. Alimony depends on certain things such as the length of the marriage and the financial situation of both spouses. Additionally, one spouse’s adultery may have an impact, particularly if it is the cause of the separation.
Child Support- Georgia provides specific guidelines for child support based on the parent’s incomes.
Child Custody- Both parents must submit a Parenting Plan. In some cases, parents will agree to a joint custody plan. If an agreement cannot be reached, each parent can submit his or her own plan, and then a judge will make the final decision.
